"In Harris v. Quinn (2014), the Supreme Court ruled in a 5–4 decision that mandatory union "fair share" fees for certain home healthcare workers in Illinois violated the First Amendment rights of employees who were not union members. The Court refused to extend its 1977 precedent, Abood v. Detroit Board of Education, to these "partial-public" employees.

Background of the case
• The Illinois program: Illinois established a program that allowed individuals with disabilities to hire personal assistants (PAs) for in-home care.
• PA employment status: The patient hired and supervised the PA, but the state, using Medicaid funds, paid the PA's salary.
• Unionization and agency fees: In 2003, Illinois passed a law designating these PAs as "public employees" solely for the purpose of collective bargaining.
The Service Employees International Union (SEIU) was elected as the exclusive representative, and a collective bargaining agreement mandated that non-union PAs pay "fair share" or agency fees to the union.

• Fir31.00st Amendment challenge: Pamela Harris and other PAs who did not want to join the union filed a lawsuit arguing that forcing them to pay union fees violated their First Amendment rights to freedom of speech and association.

The Supreme Court's decision
The majority opinion, delivered by Justice Samuel Alito, held that the mandatory fee violated the PAs' First Amendment rights.
• Limited employment status: The Court noted that unlike the teachers in the Abood case, these PAs were not "full-fledged public employees". They were hired and fired by their patients and had minimal oversight from the state.
• First Amendment concerns: The Court concluded that the First Amendment requires a compelling state interest to justify forcing individuals to subsidize a union's speech, especially when that bargaining can involve political issues related to public spending.
• Precedent of Abood: While declining to overturn Abood for traditional public employees at the time, the majority expressed serious doubts about its legal foundations. They reasoned that the justifications for agency fees, such as promoting "labor peace" and preventing "free riders," were generally insufficient to overcome First Amendment objections.
• Groundwork for Janus v. AFSCME: The Harris decision narrowed the scope of Abood and explicitly paved the way for the later 2018 ruling in Janus v. AFSCME, which fully overturned Abood and 👉 ended mandatory agency fees for all public-sector workers. 🔑

How to stop unwanted/illegal SEIU union dues and COPE political deductions without waiting for the anniversary of the date of first membership, and claim refund, as applicable by date.
Union has been ordered by the DOL Dept of Labor and the Supreme Court to stop union dues, and refund providers that write to make their claims formally. Follow instructions carefully. Union may try to deny your rights to stop dues and claim your refund, or not respond at all.
All IHSS SEIU union members or former members may send notice to STOP optional union dues and COPE deductions without waiting, or need for litigation, as far back as June 2014.
Live-in providers who qualify and claimed exempt income status may claim refunds from start date, as applicable or at least as far back as 1/2014.
Don’t give up! Those interested may write to break the union contract and stop union dues, and claim refund as qualified. Use our suggested follow up instructions, mail a 2nd letter and the 1st letter and proof of delivery, and include the evidence provided to use in precedence to succeed.

Opening: Due to the fact IHSS and Union too often refused to notify of provider
rights and options, mislead, refuse to stop dues upon resignation, or refuse to reply,
too often the IHSS and UNION officials continue to automatically join members in
orientation, and the IHSS/union forged provider signatures, the union has been
ordered to stop dues to non members, collect signatures of members, and refund
all unlawfully deducted dues, as applicable by date.
After Harris vs Quinn Supreme Court ruling 6/2014, providers have the right and option to join the Union by provider signature, or opt out, or remain in the union, or resign to stop union deductions, as is their right. Harris vs Quinn gives IHSS providers special allowances to stop dues upon demand written resignation, and signature to break the union contract, without waiting for anniversary date of joining the union.

Unfortunately, instead of the union fighting for the rights of the IHSS care providers,
the providers find it necessary to defend themselves against a union taking
advantage of the IHSS agency, and the disabled recipients, and their IHSS in home
care providers it claims to support. Through the SEIU national press department, and legal department I address the leader of the union.
Dear SEIU National President, Mary Kay Henry and the SEIU Human Relations
Legal Department and IHSS Payroll Department and all listed in cc:
1. Effective immediately, I _____________________________________ effectively resign my membership in all levels of the SEIU Union,
representing In-Home Support Services (IHSS) home care providers. I hereby
order and demand documentation of written proof of my join signature, or IHSS authorization to join the union. If the union can NOT provide evidence of my join signature, I hereby formally demand a full refund of dues the union and IHSS previously deducted illegally, as listed below in paragraph III.
2. I am writing a formal written notice to break the union contract agreement I never signed, and require formal written union response and compliance, without delay, or include additional amount correct for refund. If the union can not produce documented proof of my personal join signature, (or IHSS authorization before June 2014), within 10 business days), and fails to comply to stop dues and refund as required, further action will be required.
3. Amount of Claim: The amount of SEIU monthly dues unlawfully deducted are as follows:

I see other IHSS providers who were members of SEIU and UDW are getting their refunds back by writing to the union, or even just by calling to demand their rights. I required written formal reply within 10 business business days, and full compliance under the law, immediately.
4. Exclusive letter of evidence and verification of union leader’s signature of
approval of stopped dues, and full refund of unlawful union dues, from the date of
join, to the present date. This letter was generously contributed by a provider, to
help others. See the evidence included.
5. Union Bylaws and Invisible Undisclosed Clause/Union Loophole: Union Contract Invisible
Clause No One Sees Until Attempts to Resign. The "Authorization for Voluntary
Union Representation and Dues Check-Off" signed upon joining... (If the member
signed and wasn't "slammed" in to the union). Union members sign their rights
away upon joining and the union has been fined for each union forged provider signature, since mid 2014, and this is why SEIU and UDW requested members to “re-sign”. The DOL stopped fines to the union, and union deductions, dues and membership did not stop, if the provider opted not to “re-sign”.
6. Notification of Termination of Union Contract:
Effective immediately, resign my membership in all levels of the SEIU Service Employees International Union-Local 2015, the union designated to represent individual IHSS in home care providers. As a nonmember, I demand that SEIU immediately take the necessary action to cease and desist. Upon the receipt of my union resignation notification immediately STOP the deductions of all union dues, fees and/or political action contributions, from my IHSS paychecks as required by the U.S. Supreme Court’s decision Harris vs Quinn. 7. Please, confirm in writing within 10 days that all union dues and deductions have
ceased, as reflected on the dated month upon receipt of this letter, using US mail to
my return address, formally in reply to me. Under no condition may the union
legally collect dues after the resignation letter is received by the union. This letter
was delivered by US Mail certified proof of delivery and return signature to provide evidence of non membership admissible in court, as ruled in Harris vs Quinn US Supreme Court Harris vs Quinn Ruling.
8. As a nonmember, I demand that union immediately notify the State of California
IHSS CA Department of Social Services PAYROLL DEPARTMENT, to cease the
deduction of union dues or fees equivalent to dues from my provider checks/
payments as required by the U.S. Supreme Court’s decision in Harris v. Quinn,
2014 WL 2921708 (June 30, 2014). I discovered the fact that all IHSS providers are represented by union collective bargaining, regardless of union membership.

Since all CA Dept of Social Services officials are mandatorily members of SEIU union, the same union as many IHSS providers, I hereby quote the MMBA and NOA laws, as applicable to the IHSS state officials, SEIU, and other authorities, as applicable. How to Print and complete and Mail your Union Resignation Letter:
1. Check for errors, dates, and names, and other details.
2. Copy Paste the text from the union resignation letter to a new letter writing application or a new email to use to print your letter on paper. You can also send to a print shop to print your emailed order, for a small fee per sheet of paper, and pick up from the store.
3. Delete instructions to you at the top and bottom.
4. Enter your address and provider number.
5. Sign, and be sure to date your letter, and make several copies for your records, and also send copies to the authorities over the IHSS and union as listed above using cc: carbon copy methods, so the union can see you also mailed this resignation letter to the authorities and how aware you are of all the union noncompliance and provider rights.
6. Address the envelope to the union’s national headquarters press/legal dept, not the local union, to avoid local interference form noncompliant union officials, and IHSS state headquarters, your representatives, PERB, DOL, and DRC, and your county board of supervisors, asking for their response within 10 days.
7. Include the letter of notice to break union contract/union resignation letter, and documents provided from the provider’s former union leaders as evidence in precedence.
8. Keep copies of everything you say and do, and require written reply from officials. Avoid returning calls from the union or answer the phone or accept informal verbal methods of communication. It’s your right of MMBA and NOA laws and CDSS regulations to require formal due process and not a request. or door to union recruiters and insurance sales personnel who have not passed the IHSS background check.
9. If the union does not respond or refuses to comply in writing as required, or tries to say the provider’s union dues continue after resignation, you have options to follow up, without waiting and without need for litigation and associated costs. The next step some providers need to do, is to write again and follow-up and include the 1st letter and proof of delivery from US certified proof of delivery.
10. Ask me about follow up instructions if necessary. Mailing the copies of the first letter and proof of delivery again, and a 2nd follow up letter more strongly. I suggest some options and you may also have ideas, but there are many ways to follow up and force compliance without suing. The union's first line of defense is to not respond and deny. Now that a flood of providers force compliance to stop dues and claim refund by writing a detailed letter and including our exclusive but free documents in evidence from the union leaders, it's relatively easy and fast to claim your rights and your money.
Follow up instructions will be provided for those who have already written and mailed their union resignation letter using US certified mail proof of delivery. Quoting laws and including documents in evidence are required, and other detailed instructions are required. Union does NOT want their members to spread awareness in union meetings and events, or vote on union ballots, or pay court costs and fines, so the union will comply to law, and refund the provider’s money. Union wants to avoid refunding money to in-home care providers in California and also nationwide members.
Exempt Live in IHSS providers are entitled to claim applicable refunded union dues, as far back as 1/2014! if the live in provider claimed 2014-7 (6 more months refund). IHSS providers claiming waivers may claim refunded union dues, as far back as qualified.
